NYBAR - ニューヨーク州司法試験 の出願必要資料まとめ(2016年版)

NYBAR

(予想以上に参照いただいているようで、体裁を整えました。2018.01.02)

現在LL.M.に在籍中の知人が、卒業直後の2017年7月に
NYBARを受験するとのことで、出願に必要な資料を調査した際のメモ。
結構、出願に関する情報を探しにくく、少し理解しにくかったので展開します。
何かのお役に立てれば幸いです。
※ 当然、情報は古くなっていきますし、本家サイトの記載が正ですので、
この資料はダブルチェックに用いる程度にしてください。

要するに、必要な書類

  1. 日本で在籍していたロースクールの成績証明書
  2. 成績証明書(書類1)に学位やその取得日の明記がなければ、学位証明書
  3. 司法研修所の修了証明書( = 実務に足るだけの教育/訓練を受けたことの証明として)
  4. 在籍しているLL.M. の出席証明書
  5. (BOARDから指示を受けた場合のみ)在籍していたロースクール自体の公的な認可証明。
    ※ いずれの書類にも BOLE ID を付すこと

各必要書類に関する詳細

参照項目: Rule 520.6(b)(1) applicants (i.e., MOST foreign-educated applicants)

書類1: ロースクールの成績証明書(Official transcript)

以下の項目を含む、在籍していたロースクールによる成績証明書。
※ ロースクールがNYBAR出願資料手配に慣れていることもあるので、まず問い合わせてみるのが吉。 

- 各学期の出席日数(the dates of attendance for each period of study)  
- 各学期に選択し、かつ、合格したコース(the courses taken and passed for each period of study)  
- 評点(the grades)  
- 授業出席時間数(the number of hours of classroom attendance)  
- 取得した学位(the degree awarded)  
- 学位取得日(the date the degree was awarded)

書類2: ロースクールの学位証明書

書類1 に学位やその取得日の明記がなければ、学位証明書の取得も必要。

原文:  
If the official transcript does not clearly state the degree awarded  
and/or the date such degree was awarded, you must also furnish the degree certificate.

書類3: 実務に足るだけの教育/訓練を受けたことの証明

米国外で司法実務に足る教育要件を満たしたことの証明。具体的には、司法研修所の修了証明書で良い。

Proof of fulfillment of the educational requirements for admission to the practice of law in the foreign country

書類4: LL.M. の出席証明

LL.M. 出席証明フォームとLL.M.の成績証明書(LL.M. Certificate of Attendance Form & Official LLM Transcript.)。

原文:  
Applicants relying on the cure provision must request their U.S. law school to submit the completed  
LL.M. Certificate of Attendance Form and an Official Transcript directly to the Board  
office upon graduation.

書類5: ロースクールが認可を受けたものであることの証明

BOARDが出願者によるEvaluation formの提出を受けた際、 在籍していたロースクールが認可確認済みのロースクールのリストに存在するかを確認し、
出願者に対し、個別に認定書の提出が必要かどうかを指示します。

認定書 = ロースクールに通っていた期間中について、その学校が政府機関によって承認されていたことを示す書類

原文:
(Submit a written statement from the competent accrediting agency of  
your foreign government that the law school or schools you attended were recognized by  
them as qualified and approved throughout your period of study.)  
The Board maintains a list of law schools from which we have received proof of accreditation. The confirmation  
email that you received upon submission of your Request for Evaluation Form will  
indicate whether or not you are required to provide proof of Accreditation.

備考

「各書類がBOARDに到着する毎に、メールで出願者に通知が来ることになっています。
もし、それらの連絡が届かなかった場合には、BOARDに確認の連絡を入れてください。
BOARDへの書類の到着確認を行うのは受験者責任で、BOARDが書類に関して喚起することはないので要注意」だそうです。
(実際、個別書類の到着に合わせては、連絡を受けなかったような気もします。)

NYBAR事務局に送付する書類について

以下、提出資料に関する要件。
A. 全ての提出書類は、発行元機関や政府により厳封にて直接の郵送が必要。
B. 提出書類は、発行元の学校その他機関によって直接証明された原本、
もしくは複写である必要がある。(Aを守れば自然と満たすかと。)
C. 以下のコピーの類は、要件を満たさないためNG。(これもAを満たせば問題ないはず。)
- 公証人によって証明されたファックスコピー/コピー
- 当該学校/機関以外によって証明されたコピー
D. 全ての提出書類には、BOLEアカウントIDを付すこと。
E. 全ての提出書類は、BOARDの所有物となり、返却されないこと。
F. Online Foreign Evaluationを終える前に、書類の提出を行わないこと。
さもないと受領資料をBOLEアカウントに紐付けられない。
G. 同じ封筒に、複数の出願者の出願資料を同封しないこと。

VI. SUPPORTING DOCUMENTATION  
A. All supporting documentation must come directly from the issuing institutions and/or government agencies in a sealed envelope.
B. The documentation must consist of originals or copies certified directly by the issuing school or institution.
C. Faxed copies, photocopies certified by a notary public, and/or photocopies certified by anyone other than an official at the issuing school or institution will NOT be considered.
D. All documentation and correspondence should contain applicant’s BOLE identification number.
E. All documents become the property of the Board and will not be returned.
F. Do NOT send in any documents before you complete the online foreign evaluation as the Board does not retain documents that cannot be linked to an active BOLE account.
G. Do NOT send your documents in the same mailing envelope as another candidate.
